Notice of Intent to Broadcast

 

In order to establish your intent within the law you should notify the FCC of your intent to begin (X) number of hours per day broadcast on (X) frequency FM at (X) watts of power. You should include in your letter your understanding of the law regarding INTRASTATE NONCOMMERCIAL FM broadcasting and ask the FCC to send you a copy of any law and/or FCC regulation which contradicts your understanding of the law and and/or FCC regulations. You must state a time limit for their response. The best lawful time limit would be 10 working days from their receipt of your letter. Always send any correspondence with the FCC by CERTIFIED MAIL RETURN RECEIPT REQUESTED and keep all post office receipts for the charges on the letter. If the FCC fails to return the RETURN RECEIPT go to the post office and demand proof of delivery including the signature of the agent of the FCC who picked up the mail.

Keep on file the RETURN RECEIPT or a copy of the post office record of receipt and signature along with a copy of the letter you sent. Also keep on file any reply from the FCC... usually they do not answer notices of intent to broadcast but they could change that policy at any time.
